Mutual Recognition of Licence

What do you need to do if you want to sell or advertise a business in Queensland as a non-Queenslander?

Business brokers are registered as Real Estate Agents under the Property Agents and Motor Dealers Act 2000 in Queensland.

To practice as a business broker in Queensland you must apply for mutual recognition of your state licence or certificate. You must also meet the eligibility criteria as contained on the Office of Fair Trading website. Eligibility criteria are found under each licence or certificate type via the link above.

Corporations cannot apply for mutual recognition. If you intend to trade as a corporation, you must also apply for a corporation licence. Further information about applying for a corporation license can be found here.

Before operating in Queensland you must give the Office of Fair Trading the address of your principal place of business in Queensland.

Application for mutual recognition is made by completing one of the following forms:

Mutual recognition form 1 – Application for mutual recognition of occupational licence (PDF, 524 KB) (for business owners – contractor, sub-contractor, sole practitioner or in partnership)

Mutual recognition form 2 – Application for mutual recognition of certificate of registration/occupational licence (PDF, 503 KB) (for employee salesperson)

The forms detail the attachments/inclusions required by the Office of Fair Trading to process your application.

Once you have completed and lodged your mutual recognition licence application (along with payment of all relevant fees) you will be able to commence work in Queensland. You are able to continue working during the application period as long as your interstate license remains current. During this period you must have a copy of the receipt of payment of fees as proof of lodgement and be able to show your current interstate license.

Please note that Queensland has its own unique appointment of agent and related documents. Failure to properly complete or follow the necessary process may result in the business broker losing the right to claim commission and further penalties may apply.
